Terms of Service

By using services provided by SMMFlare, you agree to the following terms of service. If you do not agree with these terms, do not use our services.

 

1. General Provisions

1.1 Agreement to Terms

1.1.1 By placing an order with SMMFlare, you accept all terms of service listed below, whether you read them or not.

1.1.2 We reserve the right to amend these terms without prior notice. It is your responsibility to review the terms before placing an order.

1.1.3 Use our services in compliance with the terms of the relevant social media platforms (Instagram, Facebook, Twitter, YouTube, etc.).

1.1.4 You acknowledge that continued use of SMMFlare services constitutes acceptance of any changes or modifications to these terms.

 

1.2 Changes and Modifications

1.2.1 Rates may change without notice. The refund policy remains effective despite rate changes.

1.2.2 Delivery times are estimates and not guarantees. No refunds will be issued for processing delays.

1.2.3 SMMFlare reserves the right to modify service types if necessary to fulfill an order.

1.2.4 We may change the functionality or features of our services at any time without prior notice.

 

1.3 Disclaimer and Liability

1.3.1 SMMFlare is not responsible for any damages or losses incurred, including but not limited to financial losses, reputational damage, or data loss.

1.3.2 SMMFlare is not liable for account suspensions, deletions, or any other actions taken by social media platforms.

1.3.3 You agree to indemnify, defend, and hold harmless SMMFlare and its affiliates from any claims, damages, or expenses arising from your use of our services.

 

2. Services

2.1 Scope of Services

2.1.1 Our services are intended to promote your social media accounts by enhancing your appearance.

2.1.2 We do not guarantee interaction from new followers, including but not limited to likes, comments, or messages.

2.1.3 We do not guarantee that all accounts will have profile pictures, bios, or uploaded pictures.

2.1.4 Our services are provided "as is" without any warranties or guarantees of any kind.

 

2.2 User Obligations

2.2.1 Do not upload prohibited content (e.g., nudity, hate speech) to SMMFlare.

2.2.2 Private accounts will not receive refunds. Ensure your account is public before ordering.

2.2.3 Customers are responsible for regularly checking the status of their boosts.

2.2.4 Customers are liable for any loss or damages related to the use of Discord boosts or any other social media features, including but not limited to the loss of vanities, followers, business, or account bans.

2.2.5 You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device.

 

3. Refund Policy

3.1 No Refunds

3.1.1 No PayPal refunds. All deposits are final and must be used on SMMFlare orders.

3.1.2 By completing a payment, you agree not to file a dispute or charge-back.

3.1.3 Disputes or charge-backs may result in termination of your account and removal of delivered followers/likes.

3.1.4 Refunds will only be issued in the form of store credit, regardless of the circumstances.

 

3.2 Non-refundable Conditions

3.2.1 No refunds or cancellations after orders are placed. Non-deliverable orders will receive refund credit to your SMMFlare account.

3.2.2 Misplaced or private account orders do not qualify for refunds. Verify orders before placing them.

3.2.3 SMMFlare is not responsible for any issues that arise due to user error, including but not limited to incorrect order details.

 

3.3 Fraudulent Activity

3.3.1 Fraudulent activity, such as using unauthorized or stolen credit cards, will result in account termination.

3.3.2 Do not use multiple servers for the same page simultaneously; no refunds for such orders.

3.3.3 We reserve the right to take legal action against fraudulent activities and report such activities to the relevant authorities.

 

4. Privacy Policy

4.1 Data Protection

4.1.1 We protect your personal information and use it only to fill your orders.

4.1.2 Your information will not be sold or redistributed, except as required by law.

4.1.3 All personal information is encrypted and stored securely in a secure database on secure servers.

4.1.5 Only essential information is shared with our providers, which includes the link ordered and quantity. No other information is shared.

 

4.2 Example of Information Stored

4.2.1 Information such as username, email address, order details, and IP address is stored to fulfill orders and answer support requests only.

4.2.2 We take reasonable steps to protect your personal data from unauthorized access, disclosure, alteration, or destruction.

 

4.3 Data Retention

4.3.1 We retain your personal information only for as long as necessary to provide our services and to comply with legal obligations.

4.3.2 Upon request, we will delete your personal information, except where we are required to retain it for legal or regulatory purposes.

 

5. Customer Responsibilities

5.1.1 Customers are solely responsible for ensuring the security and monitoring of their social media accounts.

5.1.2 Customers must ensure that their use of our services complies with all applicable laws and the terms of service of the relevant social media platforms.

5.1.3 You are responsible for all activities that occur under your account and for maintaining the confidentiality of your account credentials.

 

5.2 Reporting Issues

5.2.1 Customers must regularly check the status of their orders and report any issues within 72 hours of occurrence. Failure to do so may result in the forfeiture of any potential refunds or credits.

5.2.2 You agree to provide accurate and complete information when using our services and to update your information as necessary.

 

6. Waiver of Consumer Rights and Right of Withdrawal

6.1 Waiver of Rights

6.1.1 By purchasing our services, you acknowledge and agree to forfeit any consumer rights protections under the laws of the United States, the United Kingdom, the European Union, and any other applicable jurisdictions.

6.1.2 This includes, but is not limited to, the right of withdrawal under the EU Consumer Rights Directive.

6.1.3 No matter the circumstances, SMMFlare will only refund the cost of the service in the form of store credit, and no other compensation will be provided.

 

7. Limitation of Liability

7.1 Limitation

7.1.1 To the maximum extent permitted by applicable law, SMMFlare shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with the use of our services, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if SMMFlare has been advised of the possibility of such damages.

7.1.2 SMMFlare's total liability to you for any claim arising out of or in connection with these terms of service or the use of our services shall not exceed the amount paid by you to SMMFlare for the services in question.

By using our services, you acknowledge that SMMFlare is not liable for any loss of business, vanities, followers, account bans, or any other damages incurred. Customers are responsible for ensuring the security and monitoring of their social media accounts and any content held with Discord boosts. We are committed to providing the best service possible, but we do not guarantee results beyond what is stated in these terms.
